Can You Use a California Marriage License in a Different County?

Back to Blog

You booked the ceremony in one place and the license appointment somewhere else. Or the license came from the clerk near home, and now the ceremony is happening at a friend’s house two counties over. Either way the question is the same: does a California marriage license only work in the county that issued it?

Short answer: no. The ceremony can take place anywhere in California. The paperwork is less flexible, though, and that is the part couples get wrong in the last 48 hours before a wedding. Here is what travels with you, and what has to go back where it came from.

A California marriage license is good statewide

Under California Family Code section 350, you obtain a marriage license from a county clerk — not from your county clerk, and not from the county where the ceremony will happen. California has no residency requirement, and nothing in the Family Code ties the place of the ceremony to the county that issued the license.

County offices say it plainly. The San Diego County Recorder/County Clerk states that the ceremony can take place anywhere in California. The Tulare County Clerk-Recorder puts both halves of the rule in one sentence: the ceremony can be held anywhere in California, but the license must be registered in the county where it was issued.

So a license issued in Los Angeles County covers a ceremony on a bluff in Santa Barbara County, a backyard in Riverside County, or a hotel rooftop in San Francisco. What it does not cover is a ceremony outside the state. A California license is for a California marriage — cross into Nevada or Arizona and you need that state’s license instead.

The completed license goes back to the county that issued it

This is the half that catches people out. Your officiant does not file the signed license with the county where you got married. It goes back to the county of issuance, within 10 days of the ceremony.

Which office receives it depends on which kind of license you have:

  • A public marriage license is returned to the county recorder of the county in which the license was issued, within 10 days after the ceremony (Family Code section 359).
  • A confidential marriage license is returned to the county clerk of the county in which the license was issued, within 10 days after the ceremony (Family Code section 506).

“Returned” has a defined meaning here. Family Code section 359 says it means presented to the appropriate person in person, or postmarked, before the time period runs out — so a license dropped in the mail on day ten still counts as returned on time.

Your officiant also writes the city and county where the ceremony took place onto the license itself, because Family Code section 422 requires it. The finished record therefore names two counties: the one where you married, and the one where the marriage is registered. That is normal. It is not an error, and it does not need correcting.

Your certificate comes from the issuing county, not the wedding county

Once the license is registered it becomes your marriage certificate, and the office that registered it is the office that sells you certified copies. Marry in Monterey County on a license from Orange County and every certified copy you ever order comes from Orange County. The county where you stood and said your vows has no record to give you.

For a confidential license the rule is tighter still. Family Code section 509 sends you to the county clerk of the county where the certificate is filed, and section 511 keeps confidential marriage records closed to public inspection without a court order. Only the two spouses can obtain copies. That privacy is a feature, but it means nobody else can order the certificate on your behalf if you picked the wrong county and moved away.

Worth knowing before you choose where to apply, because certified copies are what banks, employers, the DMV and Social Security all ask for. If you will eventually need the certificate recognized abroad, see our guide to getting a California marriage certificate apostilled — that also starts with a certified copy from the issuing county.

Changing counties does not restart the 90-day clock

A California marriage license expires 90 days after issuance, and the expiration date is printed on the face of it (Family Code section 356; section 504 for confidential licenses). There is no extension, and moving the ceremony to a different county does not buy you more time. If the license lapses, you apply for a new one and pay again — which is the whole subject of our post on what to do when a California marriage license expires.

One related detail that surprises couples: Family Code section 357 requires the county recorder to notify license holders no later than 60 days after issuance if the license has not come back yet, along with a reminder that the officiant owes it to the recorder within 10 days of the ceremony. If that letter reaches you after you have already married, it usually means the license has not been filed — call whoever performed the ceremony.

What actually differs from county to county

State law sets the substance: who may marry, the 90-day window, who may solemnize, the 10-day return. What varies locally is the practical layer — how far out appointments book, whether walk-ins are taken, the license fee, and how long certified copies take. That variation is exactly why a couple marrying this week sometimes applies in a neighboring county where an appointment is open today.

Because the license is valid statewide, doing that costs you nothing legally. Just remember that you have chosen your certificate’s permanent home at the same time.

Four situations, sorted

“We got the license in Los Angeles but the ceremony is in Santa Barbara.”

Fine. Marry in Santa Barbara, and the officiant returns the license to the issuing office in Los Angeles County.

“We live in different counties.”

Pick whichever is easier. Residency is irrelevant in California, and so is the county line between you.

“We are flying in for the weekend.”

Also fine. Non-residents marry in California on the same license as residents. Pick the county you can get an appointment in, and remember that copies will come from that county by mail later.

“We want the license and ceremony in one stop.”

That is what we do. See how the appointment works and what to bring.

How we keep the county question off your plate

Our team are Notary Publics and Deputy Commissioners of Civil Marriages authorized by the County Clerk’s office, so we can issue a confidential California marriage license and perform the ceremony in the same visit — no separate trip to the clerk. All licenses and legal forms are issued directly from the County Clerk’s office. We sign as your officiant and file the license with the county for you, which means the 10-day return deadline and the question of which office receives it are ours to track, not yours.

If you already hold a license from any California county, bring the original and we will act as officiant and file it for you. We have offices in Los Angeles, Tarzana, Orange County, San Juan Capistrano, San Diego, Oceanside and San Francisco, and we perform mobile ceremonies throughout California — compare them on our locations page. More answers on witnesses, previous marriages, timing and copies are on our FAQ page.

Both partners need to be 18 or older and currently unmarried, and to bring valid government-issued photo ID. No blood test, no residency requirement, no waiting period — you can be married the same day you receive your license.

Get married this week

One county issues the license, any county in California can host the ceremony, and the license goes home to the county it came from. That is the whole rule. Book your same-day marriage appointment and we will handle the filing from there.

Quick answers

Can we use a marriage license from one California county in another county?

Yes. The ceremony may be held anywhere in California. The completed license is returned to the county that issued it, within 10 days of the ceremony.

Does the county on the certificate show where we married or where we applied?

Both. Family Code section 422 requires the officiant to record the city and county of the ceremony, and the marriage is registered by the issuing county.

Can a California license be used for a wedding in another state?

No. It is valid for a ceremony within California only. Another state means that state’s license.

Who do we order certified copies from?

The issuing county — the county recorder for a public license, the county clerk for a confidential one. Copies of a confidential certificate are available to the two spouses only.
